Industrial Relations, Labour Relations and Employment Relationships

Corporate Advisory

The framework by which government, unions and employers interact has altered drastically over the past decade.

Whilst the role of the State in governing the relationships between key players and providing the mechanism for the resolution of disputes varies from country to country, the impact on an organization from inadequate workplace oversight and compliance is universal.

The increase flow of foreign capital into the Vietnamese economy has resulted in new challenges in industrial relations and a rise in the number of labour disputes. Recent changes to Vietnam’s labour institutions have helped foster legal compliance among organization but simultaneously increased awareness of workers’ rights. Coupled with this, strengthened dispute resolution mechanisms are providing a platform for workers to challenge corporate authority and for an increased capacity for authorities to intervene in industrial relations.

Understanding the industrial relations landscape, whether unionized or non-unionized, the role of government ministries and departments, the VGCL, the Labour Code, regional/cross-border influences on industrial action and its resolution, and provincial versus national IR strategies and objectives allows Serica to rapidly formulate responses and execute in times of stress.

Our team has advised clients across multiple sectors in industrial disputes and understands the need to quickly resolve issues among stakeholders with often very divergent interests.

We work closely with third party advisors to formulate a coordinated strategy to ensure that workplace stability can be restored as a matter of urgency and that any negative impact on corporate identity is limited.
